1. Agreement to Terms

By downloading, installing, or using the Quizi AI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access or use the App.

These Terms apply to all users of the App, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

2. Eligibility

Age Requirements

You must be at least 13 years old to use the Quizi AI App. By using the App, you represent and warrant that:

• If you are under 18, you have obtained parental or guardian consent
• You have the legal capacity to enter into these Terms

Geographic Restrictions

The App is intended for users worldwide. However, some features may not be available in certain jurisdictions due to local laws and regulations.

3. Account Terms

Quizi AI does not require user account creation. The App uses your device's App Store or Google Play account for subscription management.

Your Responsibilities

• Maintain the security of your device and app store account
• Notify us immediately of any unauthorized use
• Ensure your app store account information is accurate
• Comply with your app store's terms of service

Device Security

You are responsible for:

• Keeping your device secure
• Any activity that occurs through your device
• Preventing unauthorized access to the App

4. Subscription Terms

Subscription Plans

Billing and Auto-Renewal

• Payment Processing: All payments are processed through Apple App Store or Google Play Store
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Price Changes: We may change subscription prices with 30 days notice
• Taxes: Prices may vary by location and may include applicable taxes

Free Trial

If we offer a free trial:

• You won't be charged during the free trial period
• You'll be automatically charged when the trial ends unless you cancel
• You can cancel anytime during the trial

Cancellation and Refunds

How to Cancel:

• iOS: Settings → [Your Name] → Subscriptions → Quizi AI → Cancel Subscription
• Android: Google Play Store → Menu → Subscriptions → Quizi AI → Cancel

Refund Policy:

• Refunds are handled by Apple or Google according to their policies
• We cannot issue refunds directly
• No refunds for partial subscription periods

Subscription Sharing

Subscriptions are tied to your app store account and can be used on multiple devices logged into the same account. Subscriptions cannot be transferred between iOS and Android platforms.

5. Acceptable Use Policy

Permitted Uses

You may use Quizi AI to:

• Create quizzes from your study materials
• Test your knowledge and track progress
• Use for personal educational purposes
• Share the app with others who might benefit

Prohibited Uses

You agree NOT to:

• Violate Laws: Use the App for any illegal purpose or in violation of any laws
• Infringe Rights: Upload copyrighted content without permission
• Harmful Content: Create quizzes with offensive, harmful, or inappropriate content
• Commercial Use: Resell or commercialize the service without permission
• System Abuse: Attempt to hack, reverse engineer, or overload our systems
• Automation: Use bots, scripts, or automated tools
• Impersonation: Pretend to be someone else or misrepresent affiliation
• Interference: Interfere with other users' enjoyment of the App

6. User Content

Your Content

"User Content" means any content you provide to the App, including text extracted from images and quiz responses.

Content Ownership

• You retain ownership of your User Content
• You grant us a limited license to process your content for quiz generation
• This license is solely for providing the service to you
• We do not claim ownership of your study materials

Content Responsibility

You are solely responsible for:

• The legality of your User Content
• Ensuring you have rights to use the content
• Any consequences of sharing or using the content
• The accuracy and appropriateness of your content

Copyright Compliance

By using the App, you represent and warrant that:

• You own or have the necessary rights to your User Content
• Your use doesn't infringe third-party rights
• You comply with all applicable copyright laws

7. Intellectual Property Rights

Our Intellectual Property

The App and its original content, features, and functionality are owned by Quizi AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

What We Own

• The Quizi AI App and its source code
• Our logo, name, and branding
• The app's design and user interface
• Our proprietary algorithms and processes
• Marketing materials and website content

Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App on your devices
• Access and use the App's features according to these Terms
• This license is for personal, non-commercial use only

Restrictions

You may not:

• Copy, modify, or create derivative works
• Reverse engineer or attempt to extract source code
• Sell, rent, lease, or sublicense the App
• Use our trademarks without permission

8. Disclaimers

Service "As Is"

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

No Guarantees

We do not guarantee that:

• The App will meet your specific requirements
• The App will be uninterrupted, secure, or error-free
• Results from the App will be accurate or reliable
• Any errors in the App will be corrected

Educational Purpose Only

Third-Party Services

We use third-party services (DeepSeek API, Google ML Kit) and are not responsible for their availability, accuracy, or performance.

9. Limitation of Liability

Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Quizi AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Academic performance or outcomes
• Procurement of substitute services
• Any damages exceeding the amount paid for the subscription

Exceptions

Some jurisdictions do not allow limitation of liability, so the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Quizi AI from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content
• Your use of the App

10. Termination

Termination by You

You may stop using the App at any time by:

• Deleting the App from your device
• Cancelling your subscription (if applicable)

Termination by Us

We may terminate or suspend your access immediately, without prior notice, for:

• Violation of these Terms
• Illegal or harmful activities
• At our sole discretion for any reason

Effects of Termination

Upon termination:

• Your right to use the App ceases immediately
• No refunds for unused subscription time
• Provisions that should survive termination will remain in effect

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

• We'll update the "Effective Date" at the top
• We'll notify you through the App or app store listing
• For material changes, we'll provide 30 days notice

Your continued use of the App after changes constitutes acceptance of the new Terms.
